TheJournalofPrivateEnterprise35(2),2020,89–109AutonomyandSocialWelfare:TheAssessmentofInstitutionalizationforThoseSufferingfromMentalIllnessRandallKrieg*St.JohnFisherCollege__________________________________________________________AbstractThisstudyrecognizesthelimitationsofusingapurelyconsequentialistapproachintheassessmentofpublicpolicy.Policyproposalsaregenerallyevaluatedusingconsequentialistmethodologiessuchascost-benefitanalysis,whichdonotexplicitlyincludetheadditionalvalueofindividualautonomy.Whenrightsareimpactedbypolicy,asinthecaseofinstitutionalization,thisomissionbecomesproblematic,ofteninvolvinglitigationintheaftermathofpolicyimplementation.Toaddressthislimitation,twomodifiedconsequentialistmodelsareputforthtoassesstheissueofinstitutionalizationforthosesufferingfrommentalillness.Thesemodelsincorporatebothsocialwelfareandindividualrightsconsiderations.Twoimportantpolicyrecommendationsaremadetolessenanybiasandensurefairnessandjusticeinthehospitalizationdecision.__________________________________________________________JELCodes:B310,B410,I310,L380Keywords:publicpolicy,healtheconomics,socialeconomicsI.IntroductionCareforthosesufferingfrommentalillnesshaschangeddramaticallyoverthepasthalfcenturyandhassubstantiallyimpactedcountlesspeople.Statepsychiatrichospitalsthatlonghousedandcaredforpatientshaveclosedandpatientshavebeenreleased,freetoseekcareindependentlyinthecommunity.Thischangehasresultedingreatbenefitstosome,thankstoincreasedpersonalautonomy,andgreatcostsbornebyotherswhohavenotreceivedadequatecare.Somemembersofsocietywhosufferfrommentalillnesscouldbestbeservedthroughtemporaryhospitalization,butrefusetreatmentbecausetheybelievetheydonotneedhelp(NSDUH2015).Conversely,othersinneedfindappropriatecareoutsideof*Theauthoracknowledgesananonymousreviewerforhelpfulcomments.
