EvolutionoftheRegulatoryState:TheMixedEconomyViewedThroughaComplexityLensRobertL.FormainiFederalReserveBankofDallasThispaperexaminestheimplicationsforpublicpolicyofHayek=sconceptionofcomplexity,Prigogine=sconceptionofcomplex,self-organizingsystems,andtheASantaFe@evolutionaryparadigmasappliedtosocialandeconomicrelationships.Itarguesthat,inadynamiceconomicenvironment,thebestregulatorypolicyisflexibleruleswithinwhicheconomicrelationshipscancontinuetopermutate,ratherthanveryspecificregulationswhichconstrain,temporarily,andredirectCoftenerroneouslyCthemarket=sdynamicgrowthpathandfuturedemand/supplyrelationships.Thisconclusionfollowsdirectlyfromtheimplicationsofcomplexityforourabilitytopredictaccurately.LudwigvonMisesusedaninterestinganalogytodiscusstheproblemsfacedbygovernmentregulators.Regulations,Misescontended,werelikeanefforttodamadesert.Immediately,nomatterhowlongthedam,waterwouldrunaroundeachsideuntil,inevitably,theentireexpanseofthedesert(implyingfreedomofaction)wouldhavetobeblocked.Miseswassuggestingthatpeople,likewater,alwaysseekafreepaththatcircumventsobstaclesplacedintheirway.Theevidenceforsuchacontentionsurroundsusandisgrowingalongwithregulationitself.Considerthefollowingrecentdescriptionofthisongoingconflictbetweenthedambuildersandtherecalcitrantwater:Inscope,itwasremarkable.Inlessthantwomonthsofusingthemaneuver,bluechipcompaniesthatneededtoraisemoneyhadputthemselvesinpositiontoavoidbillionsofdollarsinfederalincometaxesbyincreasingthedeductibilityofloan
