TheJournalofPrivateEnterprise34(4),2019,1931TheHebrewRepublic?DivineAuthorityandSelf-GovernanceKyleSwanCSUSacramento__________________________________________________________AbstractThisarticlemakesacaseforthesurprisingconclusionthattheancientIsraelitetribesandpeoples,agroupthatsawitselfasanationunderGodsspecialcareandauthorityasakindoftheocracyshouldbeconsideredtohavebeenalegitimatelyself-governingsociety,completewithmanyoftheinstitutionalfeaturesofrepublicanformsofgovernment.Thesefeaturesincludearecognitionofindividuallibertyandequality,theruleoflaw,protectionsofdueprocess,andaseparationofpowers.TheargumentproceedsbyidentifyingthesefeaturesinnarrativeaccountsofIsraelshistoryintheHebrewScriptures,whichgroundGodspoliticalauthorityinthedeviceofacovenant.__________________________________________________________I.IntroductionAnindividualwhoisself-governingisautonomous.Anindividualwhoisautonomousengagesinconscious,reflectivedeliberationoveranoptionset,reachesaconclusionaboutwhattodo,andmakesareasonableattemptatdoingit.Autonomousindividualsareselfgoverninginthesensethattheyareself-directed.Societiesandpolitiescanbeself-governing,butinalooser,moreapproximateway.Generally,asocietyshouldbeconsideredlegitimatelyself-governingifithasenoughoftheinstitutionalfeaturesofrepublicanformsofgovernment.Thesefeaturesincludearecognitionofindividuallibertyandequality,theruleoflaw,protectionsofdueprocess,andaseparationofpowers.Peopleinself-governingsocietieshavewhatsomeEarlyModernthinkerscalledfederalliberty,”orthefreedomtoactaccordingtoandwithinagreeduponorconstitutionalconstraints(Elazar1998,pp.4344).Theestablishmentofasocietyorpolityinafoundationalagreementthatdefinescitizensfederallibertiesandresponsibilitiesissufficienttomakeitlegitimatelyself-governing.
