TheJournalofPrivateEnterprise37(1),2022,61-77PrivateProtectionAgenciesandInfectiousDiseasesDanSutterTroyUniversityAbstractEmergenciescriticallythreatenrightsunderconstitutionallylimitedgovernment,butbefore2020,littlescholarshipconsideredthethreatposedbyapandemic.COVID-19hasledgovernmentstoimposeunprecedentedrestrictionsonpersonalandeconomicfreedom,evenindevelopedandlargelyfreenations.Toexplorehowinstitutionsmightmoreeffectivelyprotectindividualrightsduringapandemic,thispaperexamineshowprivateprotectionagenciesunderlibertariananarchymightdealwithdemandsforprotectionfromadiseaseinprivatelyownedpublicspaces.JELCodes:H1,P1Keywords:COVID-19,emergencypowers,constitutionaleconomics,anarchy,pandemicI.IntroductionLifeasweknowitendedasgovernmentsofliberal,developed,presumptivelyfreenationsimposedpoliciestoslowthetransmissionofthenovelcoronavirus,SARS-CoV-2,andtheillnessitcauses,COVID-19.Thepoliciesviolatedtherightsandexpectationsofmillionsofpeople.“Wethoughtwelivedundertheruleoflawwithprotectionsforcommerce,freedom,andproperty,”writesStringham(2020,p.1)abouttheUnitedStates.“Suddenlywediscoveredotherwise.Itallhappenedbecauseofavirus,asubjectonwhichmosteverycitizenandnon-medicalacademic[]knowpreciouslittle.”Themeasuresimplementedhadpreciouslittleevidenceofeffectiveness(Inglesbyetal.2006).Theimplementationprocessreflectedlittleconsentofthegovernedandtypicallyinvolvedemergencyordersfromgovernors,presidents,orprimeministers.PolicepowerhaslongbeenapartoftheAmericanconstitutionalsystem,buttheextentoftheactionstakeninresponsetotheCOVID-19pandemicwasunprecedentedandseeminglyatoddswithanyreasonableconceptoflimitedgovernment.Overthepastfiftyyears,libertarianscholarshaveelaboratedasystemofcompetitioninlawandgovernancereferredtoaslibertarian
