TheJournalofPrivateEnterprise28(1),2012,79–90TheRelationshipBetweenEnforcementandthePriceofMarijuanaCliffordF.Thies*ShenandoahUniversityAbstractUsingaglobal,internet-basedsurveyoftransactionprices,therelationshipbetweenenforcementoftheprohibitionofmarijuanaanditspriceisinvestigated.Inplaceswheretheprohibitionis“strictlyenforced”ascomparedwithplaceswheremarijuanahasbeendecriminalized,thepriceissomethinglike50percenthigher.Implicationsfordecriminalizationandlegalizationarebrieflydiscussed.JELCode:K42Keywords:Marijuana;Prohibition;DecriminalizationI.IntroductionInterestinexploringalternativestotheprohibitionofmarijuanahasrecentlyrevived.AccordingtotheUnitedNationsGlobalCommissiononDrugs(2011,p.3),“Theglobalwarondrugshasfailed,withdevastatingconsequencesforindividualsandsocietiesaroundtheworld.”Thereportdescribesrecentexperimentswithdecriminalizationandadvocatesashiftinpolicyfromcriminalsanctionstolegalregulation.IntheUnitedStates,Massachusetts,in2008,bycitizeninitiative,andConnecticut,in2011,throughthelegislativeprocess,decriminalizedpossessionofsmallamountsofmarijuana.Theseactionsbringthenumberofstatesdecriminalizingmarijuanato13;theother11decriminalizedduringthe1970s.CaliforniaandColorado,twoofthedecriminalizationstates,havemovedtolegalizetheproduction,sale,anddistributionofsmallamountsofso-calledmedicalmarijuana(inspiteofthecontinuedillegalityofthesameunderfederallaw,asaffirmedbytheU.S.SupremeCourtinGonzalezv.Raichin2005).*TheauthorthanksBruceGouldy,MikeHolmes,GaryPecquet,TomSturrock,theeditor,andananonymousrefereeforcommentsonthepriorversions.79
